Defendant Donald Edward Bronston, was charged with the offenses of aggravated battery and attempted robbery by two separate
informations. The two prosecutions were consolidated for purposes of trial. A jury was waived and judgments were entered January
19, 1959, adjudging the defendant guilty of both charged offenses. He was sentenced to two indeterminate concurrent terms
of not more than five years in the Wisconsin State Reformatory at Green Bay. The defendant appeals from such judgments of
conviction. On February 13, 1958, at about nine o'clock a. m., the defendant entered a liquor store on the south side of Milwaukee. This
store was owned and operated by Mrs. Dolores Zike and her husband, and they had their living quarters in the same building.
Mr. Zilke had other daytime employment and Mrs. Zilke was alone in the building. The defendant asked for either a half pint
or pint of Scotch whiskey. Mrs. Zilke informed him that she did not have such item and he left. Approximately ten minutes
later the defendant returned. At the time of such second return Mrs. Zilke was in the basement under the living quarters,
but a bell automatically rang when the liquor store door was opened. She heard the bell, ascended the stairs, and entered
the store through a door which led from the Zilke living quarters. The defendant said, 'I am back again,' and asked for a
half pint of PM whiskey. By that time Mrs. Zilke was standing in back of, and approximately the center, of the store counter.
She turned her back in order to take the half pint of PM whiskey off from a shelf to the rear of the counter. While her back
was turned toward him, the defendant reached across the counter and struck her on the back of the head with a ratchet type
wrench.
